Marshall County Pharmacist Indicted For Stealing Drugs

A Benton pharmacist has been indicted by a federal grand jury in Paducah in connection to stealing medications.

U.S. Attorney Russell M. Coleman says in a release the indictments charge 34-year old Kyle Humphrey with stealing pre-retail prescription medications, mislabeling prescription medication in order to defraud or mislead, and wrongful use of health information. He adds Humphrey also was prohibited from possessing a firearm and is facing a separate indictment with that felony.

According to the indictment, the charges stem from on or around August 9, 2017, when Humphrey worked at a pharmacy in Calloway County and concealed numerous pre-retail medical products. He is also charged with obtaining identifiable health information relating to an individual with the intent to use the information for personal gain.

Coleman indicates the prohibited person in possession of a firearm charge stems from when Humphrey violated a court order on January 2, 2018, that was issued by Calloway County Family Court in August 2017.

If convicted, Humphrey faces up to 20 years for concealment of pre-retail medical products, up to three years for misbranding drugs, and up to 10 years for wrongful use of health information. In addition, he faces no more than 10 years for possessing a firearm while under a Domestic Violence Order.
