Judge To Rule In Cousin Murder Case




Christian Circuit Judge Andrew Self is expected to rule in the next week on a motion in the murder case against Micah Holland, which caused heated words in court Wednesday afternoon. Holland's attorney, John Herbison asked Judge Self to vacate a previous order denying a motion to dismiss the indictment.


   
Commonwealth's Attorney Lynn Pryor argued Holland created the situation that led to Joey Weatherwax's death.



Judge Self seemed to agree the situation might have been avoided that early morning September 9, 2012.


 
He did allow the defense to bring a 2x4 supposedly wielded by Weatherwax when the incident happened, because the tire tracks on it allegedly prove he was holding it when Holland ran over him. Judge Self heard all the evidence, but did not set a date that he would rule by.
