State officials along with the owner of a package liquor store are asking a federal judge to stop enforcement of a ruling which would enable grocery stores and other outlets to sell wine and liquor. The Kentucky Department of Alcoholic Beverage Control and The Party Source liquour store told U.S. District Judge John Heyburn II, in motions filed Wednesday, that the expansion of liquor sales while the case is under appeal, would be harmful.
Heyburn ruled last month that the state's law barring grocery stores, gas stations and other retailers from selling wine and liquor was unconstitutional because it violates the equal protection clause of the Fourteenth Amendment. Both the state and liquor store say they plan to appeal the decision to the U.S. 6th Circuit Court of Appeals.
